1. Scope of Services
Mold Dog of Virginia, LLC (“Inspector”) agrees to provide a K9 Mold Detection and Diagnostic Inspection at the property listed above.
Services may include, but are not limited to:
- K9 scent detection walk-through of interior
- Visual inspection of accessible interior spaces, including walls, ceilings, floors, and—when safely accessible—select areas of basements, crawlspaces, and attics at the inspector’s discretion
- Use of a non-invasive moisture meter and/or a thermal imaging camera to detect elevated moisture
- Visual inspection of HVAC systems, including air returns, supply vents, accessible ductwork, and equipment housings, for signs of visible mold, excess dust buildup, moisture accumulation, microbial staining, or other conditions that may contribute to poor indoor air quality
- Observation of exterior grading, downspouts, and drainage conditions that may affect water intrusion
- Assessment of visible building construction and materials for signs of water damage, moisture vulnerabilities, or mold-prone design flaws
All services will be performed with reasonable care. No invasive or destructive procedures will be performed without prior verbal consent of the client.
2. Payment Terms
A non-refundable deposit is required to secure the scheduled inspection. The remaining balance is due no later than the day of the scheduled service.
Accepted forms of payment include:
- Cash
- Check
- Zelle
- Venmo
Invoice is available upon request
Unpaid balances are subject to a 2% monthly finance charge. If payment is not received within 60 days of the invoice due date, the account may be submitted to collections, unless other payment terms have been agreed to in writing. The client agrees to be responsible for all reasonable attorney fees, court costs, collection agency fees, and any additional costs incurred during the collection process.
Client information will be kept confidential and used solely for purposes of providing inspection services. We do not share, sell, or disclose client data to third parties.
3. Client Responsibilities
To ensure a successful and safe inspection, the client agrees to:
● Secure all pets away from the inspection area for the entire duration of the service
● Ensure all areas of concern, including closets, crawlspaces, attics, and under sinks, are reasonably accessible
● Avoid the use of strong scents (such as candles, air fresheners, or essential oils) for at least 24 hours prior to inspection
● Disclose any known safety hazards, including exposed wiring, structural instability, traps, rodenticides, pesticides, or other toxic substances, that may pose a risk to the inspector or K9
● Notify Mold Dog of Virginia, LLC of any access limitations or hazardous conditions prior to the inspection date
4. Limitations of Liability
- Mold Dog of Virginia, LLC is not responsible for any cosmetic or structural damage resulting from approved inspection methods.
- The client acknowledges that structural weaknesses may not be visible, and assumes all risk for incidental property damage that could occur during normal access and inspection procedures.
- K9 alerts indicate the possible presence of mold but do not confirm mold growth. Environmental factors may lead to false positives or undetectable mold.
- Mold Dog of Virginia, LLC does not guarantee the identification of all mold present. The company is not liable for mold that is inaccessible, hidden, inactive, or not evident at the time of inspection.
- No warranty, express or implied, is offered regarding the presence, absence, or future development of mold or other environmental hazards.
- Referrals to third-party professionals are provided as a courtesy. Mold Dog of Virginia, LLC receives no compensation for these referrals and assumes no liability for their services or outcomes.
- In addition to residential and commercial properties, Mold Dog of Virginia also performs mold detection services on vehicles and RVs. The same limitations of liability apply fully to these inspections, including limitations regarding access, confirmation, and environmental conditions.
5. Safety & Animal Handling
- The client is solely responsible for confining all pets prior to and during the inspection.
- If an unsecured animal causes injury to the inspector or the K9 (Rudy), the client shall be held legally and financially liable for all resulting damages, injuries, medical or veterinary expenses.
- Mold Dog of Virginia, LLC shall not be held liable for any injury, illness, stress, or harm to the client’s pets or other individuals, regardless of cause, during or after the inspection.
- Mold Dog of Virginia, LLC uses a trained mold detection dog (Rudy) during inspections. The client acknowledges and accepts that a dog will be present under handler control. The client is responsible for disclosing any known allergies or sensitivities of occupants and agrees that Mold Dog of Virginia, LLC is not liable for allergic reactions, asthma flare-ups, or related health conditions. By scheduling an inspection, the client assumes all risks associated with the dog’s presence and releases Mold Dog of Virginia, LLC from any resulting claims or damages.
- If the inspection environment is deemed unsafe due to unsecured animals, property hazards, or confrontational behavior, Mold Dog of Virginia, LLC reserves the right to terminate or refuse service without refund.
- The client agrees to disclose any known property hazards, including aggressive pets, dangerous terrain, structural deficiencies, or unsecured weapons, prior to the inspection.
6. Third-Party Referrals & Professional Recommendations
Depending on the severity and complexity of findings, Mold Dog of Virginia, LLC may recommend involving an Indoor Environmental Professional (IEP) to conduct a more in-depth assessment. An IEP can provide a comprehensive evaluation and design a formal remediation protocol to guide the chosen remediation company. This ensures the remediation process is targeted, thorough, and compliant with industry standards.
Based on inspection findings, Mold Dog of Virginia, LLC may also offer recommendations for professional remediation, additional testing, or evaluation by third parties. These referrals are optional and provided solely for client convenience.
7. Cancelling & Rescheduling
Inspections require a minimum of 5 business days’ notice to reschedule. If less notice is given, we’ll do our best to accommodate a new date; however, rescheduling may result in additional travel fees. While we will work to get you back on the schedule as quickly as possible, we cannot guarantee how soon an alternative date will be available.
Cancellations at any time may result in forfeiture of the deposit.
Mold Dog of Virginia, LLC reserves the right to reschedule due to emergencies, hazardous weather, or K9 or handler health concerns, without penalty or liability.
If a client must reschedule due to uncontrollable circumstances (e.g., illness or emergencies,), no financial penalty will be imposed. However:
- Additional travel fees may still apply if costs have already been incurred.
- We will do our best to reschedule promptly, but availability is not guaranteed.
- Clients remain responsible for any nonrefundable hotel or travel expenses tied to the original appointment
If the inspector arrives and is unable to access the property or complete the inspection due to client no-show, locked areas, unsecured pets, or other preventable barriers, the client may be responsible for a return trip fee, and the deposit may be forfeited.
8. Assumption of Risk & Indemnification
The client agrees to release, indemnify, defend, and hold harmless Mold Dog of Virginia, LLC, its owners, employees, agents, and contractors from and against any and all claims, demands, losses, damages, liabilities, costs, or expenses (including attorney fees) arising out of or relating to:
- Injury to persons or animals
- Property damage, including incidental damage from standard inspection activity
- Undiscovered or missed mold presence
- False positives, environmental interference, or limitations inherent to canine scent detection
- Any costs associated with remediation, repairs, or third-party services, whether or not mold is ultimately confirmed
- Use of third-party referrals provided by Mold Dog of Virginia, LLC
- The inspection process, findings, recommendations, or any consequences thereof
Mold Dog of Virginia, LLC provides findings and guidance based our own empirically derived experience and methodology. The client agrees to waive and release Mold Dog of Virginia, LLC from all liability, claims, damages, or demands of any kind, whether known or unknown, that may arise from or relate to the inspection, the interpretation of findings, or any actions taken or not taken based on those findings.
9. Waiver of Liability & Acknowledgment of Limitations
The client acknowledges that the field of mold inspection, remediation, and mold-related health impacts is an evolving and imperfect science. There are currently no universally accepted or guaranteed tools, methods, or outcomes in mold detection or remediation planning.
Mold Dog of Virginia, LLC utilizes a layered, best-practices approach that includes canine scent detection, inspection tools, and visual observation to provide insights into potential mold-related issues. While we make every effort to provide accurate and helpful guidance, no inspection method can guarantee complete detection or prevention of mold exposure.
By signing this agreement, the client acknowledges these limitations and agrees to hold harmless and fully release Mold Dog of Virginia, LLC, including its owners, employees, contractors, and affiliates, from any and all claims, liabilities, damages, or losses that may arise from the inspection, findings, or any subsequent decisions made based on the information provided.
10. Photo & Video Release
The client grants Mold Dog of Virginia, LLC permission to photograph and/or video record areas of the property during the inspection for documentation, reporting, training, and promotional purposes. These images may include areas of concern, inspection processes, or the K9 detection team in action.
- All media will be used in a professional manner and may be published on Mold Dog of Virginia’s’ website, social media, printed materials, or other marketing platforms.
- No identifying information (such as address, full names, or private family details) will be publicly shared without additional written consent.
- The client waives any claims for compensation or ownership of such media and releases Mold Dog of Virginia from any liability associated with its use.
If the client does not wish to grant this release, they must notify Mold Dog of Virginia in writing prior to the inspection.
11. Intellectual Property & Use of Findings
Inspection findings are provided solely for informational purposes to assist the client in identifying potential mold-related concerns. Mold Dog of Virginia, LLC does not provide expert witness services, and the inspection is not intended for use in legal proceedings, insurance claims, or court testimony unless expressly agreed to in writing in advance.
Any materials, documentation, photographs, or verbal guidance shared during or after the inspection are the intellectual property of Mold Dog of Virginia, LLC. These materials—when provided—are intended for the client’s personal use only and may not be copied, distributed, altered, or submitted to third parties without prior written permission.
